Chesterfield magistrates’ court heard on Monday, April 4, how Dumitru-Florian Moise, 61, was detained by McArthurGlen Designer Outlet staff after the trainers were stolen from the store at South Normanton.

Prosecuting solicitor Rod Chapman said: “Officers were called to the McArthurGlen Designer Outlet after a report that shoplifters had been detained.

“A bag containing three pairs of training shoes was recovered from a car near to where Moise was seated. The training shoes were identified as having been stolen.

“An aggravating feature is that two foil-lined bags designed to disable store security alarms were found in the same vehicle.”

Moise, of Porters Avenue, Dagenham, Essex, pleaded guilty to the theft after the incident on December 18, 2015.

Defence solicitor Kevin Tomlinson said: “He is a married man whose wife remains in Romania and they have two children living in Japan and Germany.

“Mr Moise has been living in the UK since March 2015 having been unable to secure work as a chef in Romania.

“He has had only occasional work and has no income and no current entitlement to state benefit and depends on occasional funds from his children and from the assistance of those in his community.

“He travelled with two others and a fourth man who was the owner of the car and who owes him money.

“While at the retail outlet he was given a bag by the fourth man and was told to take it back to the car. He accepts the circumstances were suspicious and that the contents of the bag were obtained by theft.”

Deputy District Judge Derek French sentenced Moise to a 12 month community order with 100 hours of unpaid work.

He also ordered to pay a £60 victim surcharge and £85 costs.
