Dog owner is fined after brutal attack

A dog owner has been ordered to keep her German Shepherd under control with a muzzle and a lead or it could be put down after it attacked a Dachshund.

Chesterfield magistrates’ court heard on Tuesday how Eileen Bates, 72, of Warmwells Lane, Ripley, had been walking her dog Harvey along Greenway, at Marehay, when it attacked another dog walker’s pet Dachshund called Frank.

Prosecuting solicitor Becky Allsop said: “Bates’s dog barked and jumped up and was pulling on its lead and wasn’t wearing a muzzle.

“The Dachshund owner knew Bates’s couldn’t hold the dog back and it took Frank to the ground and had the Dachshund in its mouth and was attacking him brutally.”

Frank suffered a puncture wound and needed antibiotics and pain relief injections after the attack on March 10.

The court heard there had been two previous incidents involving Bates’s dog going for Frank and Bates had agreed to a Voluntary Control Order to keep Harvey on a muzzle and a lead.

Bates admitted to police she had been walking her rescue dog without both a muzzle and a lead. She pleaded guilty to being the owner of a dangerously out of control dog.

Defence solicitor Kevin Gillott said Mrs Bates had paid Frank’s vet’s fees and explained that her pet only has problems with other dogs.

Mr Gillott added Mrs Bates has a fence at her home to keep Harvey secure and she had misunderstood a previous order thinking she could use a muzzle or a lead.

Bates was ordered to pay £437 in a fine, victim surcharge and costs. She was also given a control order and warned if Harvey was not kept on a lead with a muzzle he could be destroyed.
