The jury in the Barry Smith murder trial has been told majority verdicts will now be accepted by the court.

Justice Charles Haddon-Cave QC said at Leicester Crown Court the jury had now been deliberating for nearly three days and that the law allowed him to accept a verdict that is not the verdict of them all at some stage and he felt that the case was now at that point.

The judge previously told the jury “they and they only” will decide whether three people are guilty of murdering Barry Smith and if a fourth person is guilty of assisting an offender.

It is alleged Barry Smith, 48, was beaten to death in October last year.

Vincent Aitken, 44, Emma Aitken, 19, and Nathan Doherty, 27, deny murder. Pamela Aitken, 41, denies assisting an offender.

Mr Smith was found died outside Kilburn Welfare Social club in October last year.
