Drink driver nearly crashed into police car
AN Alfreton driver involved in a near-miss with a police car had drunk more than two and a half times the legal limit.
Peugeot 407 swerved towards the patrol vehicle in Cromford Road, Hartshay Hill, Ripley, at 3.30am on October 13.
Chesterfield magistrates heard that it narrowly missed the police car and continued downhill, indicating right to turn into a filling station but carrying straight on.
Police followed and it turned into Northern Road and stopped. Officers smelled drink on driver Bartosz Gabrych’s breath.
He failed a roadside breathalyser test and went on to give a reading of 88mcgs of alcohol in 100mls of breath, the limit being 35mcgs.
“He was going through a difficult period which is now resolved. His wife had left him in circumstances which he found difficult to cope with,” said Kevin Tomlinson, for Gabrych.
“He was left with all the debts that had built up. He went for a drink after work and was on his way home. He says there was nothing of concern about the manner of his driving and he pulled up to see what police wanted.”
Gabrych (26) of Beech Avenue, Alfreton, admitted drink-driving and was fined £320, with £85 costs. He received a 22-month road ban, to be cut by a quarter if he passes a drink-driving rehabilitation course.
Mr Tomlinson said Gabrych had been working in a factory for five years since coming over here from Poland and had not gained a UK driving licence in that time. His wife and child were now living in Somercotes.
