Codnor driver is in court

A boozy Codnor motorist has been ordered off the road after a court heard he refused to co-operate with breath test procedures.

Police saw a Peugeot 206 drive past Heanor Market Place with its headlights switched off just before 1am on August 23.

They followed it towards Loscoe and spoke to driver Lee Massan after he pulled up on a filling station forecourt.

Magistrates at Chesterfield heard Massan failed a roadside breath test. He was arrested and taken to a police station where he was asked to give breath samples on an intoxilyser machine.

“He was given repeated instructions on how to blow into the device but he failed to give proper samples. “It appeared that he was pretending to be unsure of the procedure,” said Helen Griffiths, prosecuting.

Massan, 34, of Wright Street, admitted failing to provide a breath specimen for analysis.

He was fined £315, with £85 costs, and given a one-year driving ban, to be cut to nine months if he passes a drink-driving rehabilitation course.

His mother-in-law, Catherine Chadburn, spoke to the court. She said the offence took place on the anniversary of his mother’s death.

“He’s had a lot of problems in his life. His parents split up when he was three and he doesn’t see a lot of his father.

“He is generally very well-behaved. It was very much out of character,” said Mrs Chadburn.
