Boozed-up reveller caught urinating outside a takeaway

A boozed-up reveller who was spotted urinating outside a takeaway in Ripley has told how she is ashamed of what she had done and she had acted out of character.

Chesterfield magistrates’ court heard on Tuesday, May 10, how Paddiann Marie Phelan, 31, of Wharf Road, Pinxton, was seen by customers outside a pizza takeaway, on Nottingham Road, squatting down and urinating in public.

Prosecuting solicitor Gillian Foxcroft said: “It was late at night in Ripley and she had just come out of a nightclub and she was seen squatting down outside the takeaway in the snow which melted in fill view of the customers.”

When she was told she was urinating in the street, according to Ms Foxcroft, Phelan said she would walk around the corner and defecate as well.

Phelan pleaded guilty by post to committing an indecent act by urinating in a public place within the Amber Valley on January 17.

In a letter to the court, Phelan stated that she was issued a ticket for urinating while intoxicated and she had been fined £80.

She stressed that she is a good mother with two children and every day is a struggle and it had been a rare treat to have a night-out.

Phelan added that she had been ashamed of what she had done and that the person who was intoxicated on the night in question was not the person she is.

The defendant stated that she repeatedly tried to pay the fine but she was prevented from doing so because there were administrative logging delays which the Crown Prosecution Service could not explain.

Phelan subsequently received a court summons despite her efforts to put the matter behind her and move on.

Magistrates gave Phelan an absolute discharge and ordered her to pay costs of £85.
