Allotment dispute sent to controversial appeal

A COUPLE who were evicted from their prize winning plot have been granted an appeal to overturn the decision this week.

But Gary and Jane Wells of Old Coppice Side in Heanor were told their appeal would be heard by the same committee that originally banned them - instead of landlords, Heanor Town Council.

The Wells claimed the committee of Roper Avenue Allotments in Heanor ousted them as part of a ‘personal vendetta’ by one of the committee members. Letters to the Wells state that they were evicted due to a series of complaints about their conduct.

The Wells disputed that the committee had the power to evict plot holders, saying it should have been done by the town council

They issued an appeal shortly after receiving an eviction notice on March 10. The town council say they are within their rights to let the allotment committee decide the appeal.

But Jane Wells, 41, said: “By doing this they are not allowing us to be independently heard.”
